General Audience Web Site Privacy Policy
Safeguarding your privacy is very important to us. We take seriously the collection of any personally identifiable information and personal contact information ("personal information") from our visitors and are committed to protecting each visitor's privacy in accordance with these policies. We use the term "visitors" to include both registered members of the PowerFiber.com Web site and any other person that accesses our Web site at any point for any amount of time, unless designated otherwise. Please carefully review our information collection practices and privacy protections below.

Use and Collection of Information by Lightpath
To participate as a member of our general audience Web site, you may be required to provide personally identifiable information such as your name, e-mail addresses, telephone number ("personal information").
We may also survey visitors about various topics, including how we can improve our Web site and services. Response to our surveys is entirely voluntary.
We collect personal information for several important purposes, including to protect the security of our visitors and the site; improve our program service and Web site; distribute our newsletter; notify the winners of our contests and sweepstakes; and for future marketing and/or promotional use about our program service or Web site.
The only personal information this Web site obtains about you is information voluntarily provided by you. This Web site does not collect additional personal information about individual visitors or members from other sources. This means that a person can visit our Web site and navigate through the site without giving us personal information. To gauge the effectiveness of our Web site, we may collect non-personal information about our members and visitors, such as Internet server and browser identification, the Internet service provider, click-stream information, the Web page from which a person enters our site, Web pages visited, duration of visit and domain type. This information does not reveal a visitor's personal identity.
Our contests, sweepstakes, and special events may be produced with the support of non-affiliated sponsors and/or promotional partners. The personal information collected by our Web site in conjunction with such events may also be used for the marketing of additional services and events by Lightpath and/or its promotional partners and sponsors beyond the contest, sweepstakes and/or special events. Depending on the event, visitors will be able to either grant their approval on how their personal information will be used before it is collected ("opt-in"), or choose to deny use of their information for additional purposes ("opt-out"). For each contest, sweepstakes and/or special event, we will post on the Web site applicable rules for the event, and if necessary, post any supplemental terms and conditions or privacy provisions.
Use of Cookies and Tracking Devices
This site uses cookies or other tracking devices. A cookie is a small data file that contains a unique identification number that a Web site places on your hard drive when you visit a site. The "cookie" is able to store information such as data about your computer, the type of browser you use, and how many times your computer visits a certain site. Cookies do not allow the Web site to access personal information that you haven't already provided. Cookies enable us to track how often visitors are visiting our Web site and specific pages, estimate the audience size for sponsors and advertisers, and to track user preferences. You can refuse to use cookies by turning them off in your browser. Please contact your software manufacturer for questions on how to disable your cookies. You do not need to have cookies turned on to use most of this site. However, you may find that some areas on the Web site will be slower, or may not function at all, and you may not be able to participate in certain activities if the cookies are disabled.
This site does not use clear GIFs (Graphics Interchange Formats, also known as pixel tags, Web beacons, or Web bugs). A clear GIF is a tiny line of code only 1 by 1 pixel in size that is programmed to collect certain information about a visit to a particular Web site. Other Web sites may use clear GIFs to track non-personal or personal information. Lightpath, its parents and subsidiaries are not responsible for such the use of clear GIFs by other Web site operators. Visitors must review other Web site operators' privacy policies to determine the type and extent of tracking devices use.
Use and Collection of Information by Advertisers and Sponsors
Our Web site may post links to the Web sites of sponsors or partners which are companies that are not owned or operated by Lightpath, its parents, affiliates or subsidiaries. These sponsors or partners may independently solicit and collect personal information, or send their own cookies to our visitors. Please be advised that when you visit an partner or sponsor's Web site you will be subject to the privacy policy and terms of usage agreement of that Web site operator. Lightpath, its parents, partners, affiliates or subsidiaries, will not be responsible for advertiser or sponsor ads and/or links or the content, activities, information collection, use and disclosure practices of the Web sites of partners and sponsors.
Our Policy on Disclosing your Information to Parties other than Lightpath
We only share or disclose your personal information with companies other than Lightpath when it is required by law, disclosure is necessary to operate the Web site or our Web site services, and/or to protect the safety of our visitors, employees or property.
Lightpath is solely owned by Lightpath Holdings, LLC ("Holdings") and we may in the future share personal information with Holdings, its affiliates, or other entities for other purposes. If we decide to enter into such sharing arrangements, we will disclose in this Privacy Policy the name of the entity(s) that we will share information with, what type of personal information will be shared, how the information will be used, and how to contact us if you do not want us to share your personal information ("opt-out"). We currently conduct joint activities with members of the Lightpath family; however, we will not share individual visitors' personal information with these entities unless we provide notice in this Privacy Policy.
When visitors send an e-mail to us, we will protect your e-mail address and other personal contact information. However, we may disclose the content of your e-mail to other persons. Please see our Terms of Usage Agreement. We may share your personal information with our operational providers or those persons, companies, or agents who provide support for the internal operations of the Web site, such as contest fulfillment services, maintenance and technical services, and e-commerce and auction contractors. If you are purchasing goods, merchandise or services on this Web site and use a credit card to complete the transaction, our operational providers may share your personal information and credit card number with a ticket agent, a credit card processing and/or a shipping/fulfillment company in order to complete your order.
We may provide aggregate information about our visitors to our advertisers, sponsors, promotional partners and affiliates, such as how many persons visited a particular page or activity, the average age of our visitors on the site or page, or the likes and dislikes of our visitors, but this information does not include personal information about any individual visitor. We may obtain geographic information such as zip code clustering from other sources, but this aggregate information will not reveal any personal information about a specific visitor.
CPNI Policy
Customer proprietary network information (“CPNI”) is information that relates to the quantity, technical configuration, type, destination, location, amount of use and billing information of your telecommunication services with Lightpath. Federal law governs our use and sharing of your CPNI, and you can limit the sharing of your CPNI if you do not want us to use it to market services to you that are different than those you are currently receiving. Our Security Procedures
We require our employees to protect the privacy of all information collected over our Web site. Only employees and supervisors with specific authorization have access to databases containing visitors' personal information. The databases are protected in a secure facility. Credit card information is transmitted via encrypted technology. If we decide to share visitor information with other members of the Lightpath family, the receiving entity will also maintain the security and integrity of personal information collected over our Web site.
For the convenience of our visitors, we may offer a list of helpful Web site links provided by other entities and/or persons. Lightpath does not endorse or recommend, nor is it liable for, the products or services of any Web sites not owned or operated by Lightpath. When you visit other Web sites you will also be subject to the privacy policies and terms of usage agreements, if any, of that Web site operator.
Notification of Changes in the Privacy Policy
We will review our security measures and Privacy Policy on a periodic basis, and we may modify our policies as Lightpath deems appropriate. We may also change or update our Privacy Policy if we add new services or features and will post these changes in this policy. We encourage you to review our Privacy Policy on a regular basis.

PowerFiber Acceptable Use Policy
Acceptable Use Policy for Internet Service
The Acceptable Use Policy (AUP) has been created by Lightpath to promote the integrity, security, reliability, and privacy of Lightpath’s network. The AUP works in conjunction with the PowerFiber Master Services Agreement and specifies actions that are prohibited by users of the Lightpath network. Lightpath reserves the right to modify the AUP at any time and any such modification shall be automatically effective as to all users when adopted by Lightpath. Each Customer of the Service is responsible for ensuring that the use of all Services provided complies with this AUP. Any user who does not agree to be bound by these terms should immediately stop their use of the Service.
1. Illegal Use
The Service may be used only for lawful purposes. Transmission or distribution of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Furthermore, use of the Service to impersonate a person or entity is not permitted.
2. System and Network Security
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation, the following:
- Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
- Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
- Interference with Service by any user, host or network including, without limitation, mail bombing, flooding, or denial of service attacks.
- Forging the header of any transmitted information packet, email or Usenet posting.
- Modifying or tampering with any hardware, software, or configuration provided by Lightpath including but not limited to routers, switches, and cable modem configuration files.
- Disrupting any aspect of the Lightpath Internet Network through any means.
- Excessive use of bandwidth that, in Lightpath’s sole opinion, goes above normal usage or goes beyond the limit allocated to the user.
- Assuming or assigning an Lightpath IP address that was not allocated to the user by Lightpath or its network. Business users should refer to the PowerFiber Master Services Agreement for further clarification.
3. Electronic Mail
Spam – Lightpath defines Spam (“SPAM”) as any email or electronic communication including, but not limited to, instant messenger programs, IRC, Usenet, etc. that promotes or advertises a service, product, cause, opinion, money making opportunity, or the like that the recipient did not specifically request from the sender. The communication does not necessarily have to pass through the Service’s email infrastructure – it only needs to originate from a service user. Residential service users may not send any communication meeting the definition above regardless of whether the recipient requested it or not. Business users should refer to their contract for further clarification of this issue.
Lightpath maintains a zero-tolerance policy regarding SPAM for all of its Internet products and will take immediate action against users violating this policy.
Lightpath’s PowerFiber Internet Service may not be used to collect responses from unsolicited email regardless of the email’s origination. Moreover, unsolicited email may not direct the recipient to any web site or other resource that uses the Service and the user may not reference the Service in the header or by listing an IP address that belongs to the Service in any unsolicited email even if that email is not sent through the Service or its infrastructure.
Users may not send any type of communication to any individual who has indicated that he/she does not wish to receive messages from them. Continuing to send email messages to anyone that has expressly requested not to receive email from you is a violation of this policy.
4. USENET/Internet Chat
Users may not SPAM newsgroups or chat rooms and must comply with the written charters, FAQs, rules, or terms of service for those forums the user chooses to participate. The user is responsible for determining the policies of a given group/room before posting to it. Additionally, users are not permitted to:
- Cross-post the same or substantially similar message excessively
- Post binary files to non-binary groups
- Flood or disrupt a group
5. Abusable Resources
Customers shall take all necessary steps to avoid actions that result in the abuse of a resource on their network. Examples of abusable resources include but are not limited to open news servers, open SMTP servers, insecure routers, wireless access and insecure proxy servers. Upon notification from Lightpath, users are required to address the problem in a timely fashion. Failure to address an issue after notification will be considered a violation of this AUP. Not all products permit use of these types of services; please refer to the PowerFiber Master Services Agreement for further clarification.
6. User Responsibility
The user is solely responsible for the security and misuse of any device that is connected to the Service. Lightpath recommends that users implement appropriate measures to secure their systems and these measures may include installation of firewalls, antivirus protection with regular updates, regularly checking for and applying security patches for software and operating systems, and general security protections in their use of the Service.
7. Viruses
Service users must take appropriate action to prevent their systems from becoming infected with and/or distributing computer viruses. Lightpath will take appropriate action, in its sole discretion, against users infected with computer viruses or worms to prevent further spread.
8. Enforcement
Lightpath reserves the right to investigate violations of this AUP, including the gathering of information from the user or users involved and the complaining party, if any, and the examination of material on Lightpath’s servers and network. Lightpath prefers to advise customers of AUP violations and any necessary corrective action but if Lightpath, in its sole discretion, determines that a user has violated the AUP, Lightpath will take any responsive action that is deems appropriate without prior notification. Such action includes, but is not limited to, temporary suspension of service, reduction of service resources and termination of Service. Lightpath is not liable for any such responsive action and these actions are not exclusive. Lightpath may take any other legal or technical action it deems appropriate to remedy violations of this policy.
The failure of Lightpath to enforce this AUP, for whatever reason, shall not be construed as a waiver of any right to do so at any time.
